UNDER THIS AGREEMENT. NO CLIENTSOURCE, INC. SUPPLIER SHALL HAVE ANY LIABILITY UNDER THIS AGREEMENT WHATSOEVER. CLIENTSOURCE, INC. AND CLIENTSOURCE, INC.'S SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS), EVEN IF CLIENTSOURCE, INC. OR ITS SUPPLIERS HAS BEEN ADVISED OF SUCH POSSIBILITIES. CLIENTSOURCE, INC. SHALL NOT BE LIABLE FOR ANY THIRD PARTY CLAIMS RELATING TO THE WEBSITE AND ITS CONTENT. THE LIMITED WARRANTY, LIMITED REMEDIES, AND LIMITATION OF LIABILITY PROVISIONS CONTAINED IN THIS AGREEMENT ARE FUNDAMENTAL PARTS OF THE BASIS OF CLIENTSOURCE, INC.'S BARGAIN HEREUNDER, AND CLIENTSOURCE, INC. WOULD NOT BE ABLE TO PROVIDE THIS SERVICE TO YOU ABSENT SUCH LIMITATIONS. Services to be Performed: ClientSource, Inc. will provide a customizable web site and website hosting service needed to make Customer's site accessible on the Internet. ClientSource, Inc. Agrees as Follows: ClientSource, Inc. will provide Customer with a user name and password that Customer can use to access and change his/her website. ClientSource, Inc. will allow a risk-free trial to continue for a period of 30 days after initial website setup. ClientSource, Inc. will keep all billing and personal information private and will not furnish outside parties with this information. Customer Agrees to as Follows: Customer agrees to recommend clients to review his/ her newly activated website to assist his/her evaluation process. If Customer wishes to change the textual content of his/her site, that it be done in good taste and with a goal of increasing the professional depth of the site. If Customer believes that any original information is incorrect, that Customer will contact ClientSource, Inc. with possible corrections. Customer agrees to begin the automatic renewal fee at the end 30 days unless ClientSource, Inc. is contacted before the end of that time with specific instructions to discontinue service. Customer agree to allow ClientSource, Inc. to provide the necessary hosting services. Customer Agrees to Compensate ClientSource, Inc. $49.50 per month as the automatic renewal fee. This agreement shall for all purposes be governed by and interpreted in accordance with the laws of the State of Vermont, USA, as those laws are applied to contracts entered into and to be performed entirely in Vermont by Vermont residents. The United Nations Convention on Contracts for the international sale of goods is specifically disclaimed. If any provision of this Agreement is held by a court of competent jurisdiction to be unenforceable for any reason, the remaining provisions hereof shall be unaffected and remain in full force and effect. This agreement is the final, complete and exclusive agreement between the partied relating to the subject matter hereof, and supersedes all prior or contemporaneous understandings and agreements relating to such subject matter, whether oral or written, and may not be amended except by writing executed by both parties.
